1. Who we are
Refurb Online is an online retailer of refurbished IT hardware based in South Africa. When these terms say "we", "us" or "our", they mean Refurb Online. "You" means the person or business placing an order on refurbonline.co.za. A "consumer" is an individual buying for private use; every other buyer is a "business customer".
We sell online only. We have no showroom and do not offer collection.
2. Agreeing to these terms
Placing an order on this site means you accept these terms, our Warranty, Returns and Delivery policy, and our Privacy Policy. If you are ordering on behalf of a business, you confirm you are allowed to bind that business.
These terms apply to every sale unless we have agreed something different with you in writing. We may update them from time to time. The version on the site when you place an order is the one that applies to that order.
3. Orders, quotes and confirmation
An order you place is an offer to buy. We accept it when your payment has cleared and we have confirmed that the item is available. Until then no contract exists, even if you have received an automated email. All orders are subject to stock availability.
A written quote is valid for 7 days from its date unless the quote says otherwise. Please check any quote or pro-forma invoice carefully and tell us straight away if something is wrong; once you have paid against it we will supply what it describes.
We may decline or cancel an order before dispatch if the item is no longer available, if there was an obvious error in the listed price or specification, or if we suspect fraud. In every such case we refund you in full, promptly.
If an item cannot be supplied we will offer an alternative of equal or better specification at the same price, or a full refund. You choose.
4. Pricing and VAT
All prices are in South African Rand. Product pages show the price excluding VAT, with the VAT-inclusive price alongside. The total you pay at checkout includes VAT at the current rate.
Prices can change without notice, including where exchange rates, duties or freight costs move. The price you pay is the price shown when you complete checkout or the price on a quote you accept within its validity period.
Errors and omissions excepted. If a listing contains a clear mistake in price or specification we may cancel the affected order and refund you, even after payment.
5. Payment and ownership
Payment is due before dispatch. You can pay by card or instant EFT through Paystack, or by manual EFT (bank transfer) using the banking details on your pro-forma invoice. Your card details are entered on Paystack's page and never reach us.
Orders paid by manual EFT are processed only once the funds reflect in our account or valid proof of payment is received. Use your invoice number as the payment reference.
Ownership of the goods stays with us until you have paid in full. Until then we may recover the goods if you are in breach of these terms. Risk in the goods passes to you on delivery.
Where we have agreed credit terms with a business customer in writing, overdue amounts attract interest at the maximum rate the law allows, and the customer is liable for our reasonable costs of recovery. We may hold further deliveries and services until the account is settled.
6. Delivery
We deliver nationwide by courier at a flat R350.00 excl. VAT per order unless we quote otherwise. We may quote separately for servers, large items and orders of 5 or more units.
We dispatch after payment has cleared and stock is confirmed. Delivery normally takes 2 to 5 business days from dispatch. Any delivery date we give is an estimate, and we are not responsible for courier delays beyond our control.
Where an order contains several items we may deliver them in more than one parcel, at no extra cost to you.
7. Inspection on arrival
Please inspect the parcel when it arrives. Record any damage, shortage or wrong item on the courier's waybill before you sign for it, and tell us within 48 hours with photographs. Transit claims reported later may not be accepted.
A business customer who believes goods do not materially match the order must tell us in writing within 7 business days of delivery; otherwise the goods are taken as accepted.
8. Returns and cancellation
Consumers may cancel an order within 7 business days of delivery and return the goods for a refund. The goods must be unused, undamaged, complete and in their original packaging, and are returned at your risk and cost. We refund within 30 days of the goods reaching us, less a reasonable deduction for anything missing or for damage caused after delivery.
If you decline the operating-system licence when the device is first switched on, only the complete product can be returned, within the same window that applies to your order.
Faulty, damaged or misdescribed goods are collected at our cost and repaired, replaced or refunded at your choice, as the Consumer Protection Act provides.
Business purchases, bulk orders, rentals and any order placed on a written quote are not eligible for change-of-mind returns. Activated software licences and opened consumables cannot be returned.
Goods being returned for any reason must be made available for collection when we reasonably ask. The full procedure and timelines are set out on our Warranty, Returns and Delivery page, which forms part of these terms.
9. Warranty
Every refurbished device carries a 12-month collect-and-return warranty against hardware failure under normal use, starting on the delivery date, regardless of cosmetic grade. Where the extended warranty is bought at checkout, cover runs for 24 months from delivery.
Batteries are covered for the first 12 months only, including under the extended warranty. Spare parts and accessories sold on their own are covered for 90 days from invoice.
We repair with new or equivalent-to-new parts, or replace with an equivalent unit. Where a part or replacement unit is not immediately available, it is ordered in; this can take 2 to 3 weeks and we will keep you informed. Parts and units we replace become our property.
The warranty covers the device as specified in its listing. We do not warrant that a product is suitable for any particular purpose, or will reach any particular performance level, unless we have agreed that with you in writing. The exclusions and claims process on our Warranty page apply.
Nothing in this section removes the rights you have under the Consumer Protection Act.
10. Product condition and images
Unless a listing says "new", every product is refurbished and carries a cosmetic grade of A, B or C as explained on our How We Grade page. Wear that matches the grade is expected, accepted and not a defect.
Photographs show the model, not the exact unit you will receive. Colour, keyboard layout, port arrangement and minor details can differ. The written specification on the product page is what we supply.
11. Software
Where an operating system is listed it is installed and activated. No other software is included unless the listing says so. Software licences are subject to the publisher's own terms, and software faults, viruses and configuration issues are not hardware defects.
12. Your data
You are responsible for backing up any data on a device before returning it to us for any reason, and for keeping current backups generally. We may need to wipe a device during repair and cannot recover data afterwards.
13. Bulk orders and rentals
Orders of 5 or more units, and all rental agreements, are handled on a written quote. The quote, and any rental agreement you sign, take precedence over these terms where they differ.
14. Limitation of liability
We are not liable for indirect or consequential loss of any kind, including lost profit, lost revenue, lost data or downtime, arising from our products, our services or late or unavailable stock.
We are also not liable for loss you could have avoided by following our reasonable advice and instructions, for loss caused by materials or instructions you supplied, or for loss arising from a failure to keep proper, up-to-date backups of your programs and data.
Our total liability for any order is limited to the amount you paid for that order. Nothing in these terms limits any right you have under the Consumer Protection Act or any other law that cannot be excluded.
15. Confidentiality and assignment
Each of us will treat information received from the other that is plainly confidential with at least the same care as our own confidential information.
We may subcontract fulfilment, delivery and repair work, and may transfer our rights under these terms, provided your rights are not reduced. You may not transfer your rights or obligations without our written consent.
16. Ending the agreement
Either of us may end the agreement for an order if the other commits a material breach and does not put it right within 30 days of written notice, or becomes insolvent or unable to pay debts as they fall due. We may end it immediately if you fail to pay when due.
17. Privacy
We handle your personal information under the Protection of Personal Information Act. Our Privacy Policy explains what we collect and why.
18. General
These terms are governed by South African law and any dispute will be heard in the South African courts.
If any part of these terms is found to be unenforceable, the rest still applies.
